Article 1-5 POWERS AND DUTIES OF OFFICERS
1-501 Mayor--Bond and
Duties.
Repealed. (Ord. No. 83-5, 3-1-83).
1-502 Councilmen--Bond and
Duties.
Before entering upon the duties of their office, each Councilman shall
execute to the City a bond in the sum of One Thousand Dollars.
A majority of all the members elected to the Council shall constitute a
quorum for the transaction of any business of the City, but a less number may
adjourn, from time to time, and compel the attendance of absent members. The
Council may elect one of their body, who shall be styled the "President of the
Council," who shall preside at all meetings of the Council in the absence of
the Mayor, and in the absence of the President of the Council, the Council may
elect one of their own body to occupy his place temporarily, who shall be
styled "Acting President of the Council," and the President and Acting
President, when occupying the place of the Mayor, shall have the same
privileges as other members of the Council, and all acts of the President or
Acting President, while so acting, shall be as binding upon the Council and
upon the City, as if done by the Mayor. (4-2, Rev. Ord. 1938; Rev. Ord. 1963).
1-503 City Attorney--Bond and Duties.
Before entering upon the duties of his office, he shall execute to the
City a bond in the sum of One Thousand Dollars.
The City Attorney shall be the legal advisor of the Council and City
Officers; he shall commence, prosecute and defend all suits and actions
necessary to be commenced, prosecuted or defended on behalf of the City, or
that may be ordered by the Council, and shall attend meetings of the Council,
and give his opinion upon any matter submitted to him, either orally or in
writing, as may be required. He shall draft all ordinances, contracts and
other instruments necessary to conduct regular city business. He shall do all
other things provided for by ordinances or required by law. (Ord. 5, 8-4-04;

1-503.1 Assistant City
Attorney--Duties.
The Assistant City Attorneys shall perform such duties as designated by
the Mayor and the City Attorney jointly. (Ord. No. 2115, 7-2-23, Ord. No.
77-25, 7-19-77, Rev. Ord. 1979).
1-503.2 Duties Not Exclusive.
The offices of City Attorney and Assistant City Attorneys shall not be
deemed or considered to be full time positions, and the holders thereof shall
be entitled to do other legal work, not involving the city directly or
indirectly, and to appear in any court, other than the Police Court of the
City of Rock Springs, on civil or criminal matters in which the City of Rock
Springs has no direct or indirect interest. (Ord. No. 77-26, 7-19-77).
1-504 City Clerk--Bond and
Duties.
Before entering upon the duties of his office, he shall execute to City a
bond in the sum of One Thousand Dollars.
He shall have the custody of all laws and ordinances, shall attend the
sittings of the City Council, and shall keep a correct journal of the
proceedings of the Council, which journal, after the approval of each sitting
of the City Council, shall be signed by the Mayor and attested by the Clerk.
He shall keep a record of all outstanding bonds against the city, showing the
number and amount of each, for and to whom said bonds were issued, and when
any bonds are purchased, or paid, or cancelled, said record shall show the
fact, and in his annual report, he shall describe particularly the bonds
issued and sold during the year, and the terms of sale, with each and every
item of expense thereof. He shall attest all orders and drafts upon the
Treasurer and affix thereto the seal of the City, and keep an accurate record
thereof in a book provided for that purpose. He shall make at the end of each
month a report showing the amount appropriated to each fund, and the whole
amount of warrants drawn thereon, which shall be spread at large upon the
records, and at the end of each year, a report embracing a summary of such
monthly reports. He shall keep the Corporate Seal, papers and books belonging
to said City. He shall attest and affix the Corporate Seal to all bonds and
licenses, issued in pursuance of the orders of the City Council and the
ordinances of the City. He shall issue requisitions to the various officers
and employees of the City, authorizing the purchase of supplies, repairs and
equipment incidental and necessary in the ordinary course of City business,
provided, however, that he shall issue no requisition for supplies, repairs,
and equipment not incidental and necessary in the ordinary course of City
business without first having obtained express authorization from the Mayor
and City Council. He shall also perform such other duties as may be required

1-505 City Treasurer--Bond and
Duties.

1-506 Chief of Police.
Before entering upon the duties of his office, the Chief of Police shall
execute to the City a bond in the sum of Five Thousand Dollars.
It shall be the duty of the Chief of Police to attend all meetings of the
Council. The Chief of Police shall perform the duties incumbent upon such
office, and shall have the immediate superintendence of the Police Department.

1-507 Municipal Judge--Bond and
Duties.
Before entering upon the duties of his office, he shall execute to the
City a bond in the sum of One Thousand Dollars.
It shall be his duty to hear and determine all offenses against the
Ordinances of the City, arising within the limits of the City. The Municipal
Judge shall be a conservator of the peace, and his court shall be open every
day except Sundays and legal holidays, to hear and determine all cases
cognizable before him. No act shall be performed by him on Sundays and legal
holidays, except to receive complaints, issue process and take bail. He shall
file monthly reports of all money collected and paid to the City Clerk, and
shall, on the last day of each month, pay to the City Clerk all money in his
hands. Said reports shall state the cases filed in his court, how disposed of,
and other matters of information concerning his office.
He shall perform such other duties as may be required of him by the
Ordinances of the City, provided they do not conflict with the laws of the
State of Wyoming or the laws of the United States of America. In case a
Municipal Judge is absent temporarily or unable to perform the duties of his
office, the Mayor may appoint a suitable person to act as Municipal Judge

1-507.1 Alternate Municipal
Judge--Duties. The Alternate Municipal Judge shall act only in the absence or
disqualification of the Municipal Judge.
The Alternate Municipal Judge, when on duty, shall perform all of the
duties of the regular Municipal Judge. (Ord. No. 2115, 7-2-73; Ord. 87-18,

1-508 Fire
Chief--Duties.
The Chief of the Fire Department shall have charge of the Fire Department
of the City. He shall have control and command of all property belonging to
the Department; he shall superintend and direct the acts and doings of the
Firemen, and shall prescribe such rules and regulations as may be necessary,
subject to the approval of the Council. He shall see that the Ordinances of
this City with reference to the Fire Department are faithfully observed. He
shall have command at all fires over all officers and persons who may be
present and shall take all proper measures for the extinguishment of fires,
protection of life and property, and the preservation of law and order. He
shall report quarterly in writing, the fires occurring during that quarter and
doings of the Fire Department, and make all suggestions and recommendations he
deems proper. He shall perform such other duties as may be required of him by
the Ordinances of the City. (4-8, Rev. Ord. 1938; Rev. Ord. 1963).
1-509 Director of Engineering and
Operations--Duties.
The Director of Engineering and Operations shall, when requested by the
City Council or Mayor, make all surveys, estimates, maps and profiles required
for any City work or improvement
The Director of Engineering and Operations shall also assist other
departments when a problem or questions arise which requires engineering
expertise.
The Director of Engineering and Operations shall keep records showing the
official grades of all streets, sidewalks, curbs and gutters, and the location
of all connections therewith, and of all fire hydrants and of all valves in
water mains. The Director of Engineering and Operations shall keep any other
records the Governing Body requires and turn all papers, records, books and
maps over to his successor as required under W.S. 15-3-212. The Director of Engineering and Operations shall have supervisory
authority over any subordinate engineers and shall all have supervisory
authority over the operation and maintenance of the city streets, the water
department and the cemetery.

1-510 City Health
Officer--Duties.
The City Health Officer shall see that all laws and ordinances relating to
the health and sanitary conditions of the City of Rock Springs, and the
regulations and orders of the Board of Health are strictly enforced and
observed. He shall keep a full record of all transactions of the Board, as
well as all reports pertaining thereto. He shall have the power of a Police
Officer in the enforcement of all sanitary rules, ordinances and regulations
of the said Board of Health and of said City. He shall also render to the City
Council each month a brief report of the sanitary and health conditions of the
said City, together with such recommendations and observations as he or the
Board of Health may desire to make. He shall inspect the City jail each month
and also attend all persons in the custody of the City Marshal who may be in
need of medical attention. He shall perform such other duties as may be
required of him by the Ordinances of the City. (4-10, Rev. Ord. 1938; Rev. Ord.

1-511 Street
Commissioner--Duties.
The Street Commissioner shall, subject to the orders of the Mayor and
Council, have general charge, direction and control of all work in the
streets, sidewalks, culverts, and bridges of the City, and shall perform such
other duties as may be required of him by the Ordinances of the City. (4-11,
Rev. Ord. 1938; Rev. Ord. 1963).
1-512 City Inspector--Bond and
Duties.
Before entering upon the duties of his office, he shall execute to the
City a bond in the sum of One Thousand Dollars.
He shall be ex-officio building inspector, sewer inspector, plumbing
inspector, gas inspector, sidewalk inspector, and city electrician, and as
such shall supervise the enforcement of all Ordinances and regulations
relating to buildings, building operations, and construction, including
Ordinances applicable to electrical installations, signs and awnings. He shall
also have supervision over all connections made to the City's sewer system. It
shall be unlawful for the City Inspector or any Deputy Inspector employed by
the City of Rock Springs, to engage in the building or construction business,
plumbing business, gas business, or electrical business, either directly or
indirectly, and he shall have no financial interest in any concern engaged in
such businesses in the City of Rock Springs at any time while holding such
office. Any violation of the provisions of this section by said City Inspector
or any Deputy Inspector shall be sufficient cause for removal from office. The
City Inspector shall perform such other duties as may be required of him by

1-515 City Planner--Duties.
The City Planner shall perform such duties as designated and directed by
the Mayor and the Director of Public Services. (Ord. No. 2222, 7-1-74).

Department of Engineering, Planning, and Development--Duties.

1-517 Director of the Department
of Finance Administration--Duties.
The Director of the Department of Finance Administration shall direct and
control the budgetary, planning and operational activities of the department,
and shall perform such other duties and functions as may be required of him by
the Mayor or the Ordinances of the City. (Ord. No. 2159, 12-27-73).
1-518 Director of Public Services
- Duties.
The Director of Public Services shall direct and control the budgetary,
planning and operational activities of the Department of Public Services, and
shall perform such other duties directed by the Mayor. The Director of Public
Services shall supervise the operations and activities of the Wastewater
Treatment Plant, the personnel who perform various inspections, the planning
and zoning department and the maintenance of City vehicles. (Ord. No. 2159,

The Director of Public Safety shall be in general charge of public safety
as designated by the Mayor, which duties may include general supervision of
the police department and the fire department. (Ord. No. 77-6, 4-5-77).
1-520 Director of
Parks and Recreation--Duties.
The Director of Parks and Recreation shall direct and control the
budgetary, planning and operational activities of the department, and shall
perform such other duties and functions as may be required of him by the Mayor
