Article 2-1 JURISDICTION AND PROCEDURE


2-100     Municipal Court

     Whenever in this chapter or any ordinance of the City of Rock Springs reference is made to "Police Court" or "Police Justice", such court or justice shall hereafter be referred to as "Municipal Court" and "Municipal Judge". (Ord. No. 89-30, 12-5-89)

2-101     Exclusive Jurisdiction

 
    The Police Justice shall have the power and jurisdiction as provided by the laws of the State of Wyoming for police justices of municipal courts, and it shall be his duty to try, hear and determine all cases arising under the Ordinances of the city, and all complaints for the violation of said Ordinances. He shall hold court each day, except Saturdays, Sundays and legal holidays, for the trial of such cases, and the transaction of such business as may properly come before him. He shall hold court at such regular hours as he may designate, and at such other times as may be necessary. No act shall be performed by him on Saturday, Sundays or legal holidays, except to receive complaints, issue process, and take bail. He shall have power to enforce due obedience to all orders, rules and judgments made by him; to issue warrants, subpoenas and other process that may be necessary for the attendance of witnesses; and he may fine or imprison any person for contempt offered to him while holding court, or to process issued by him, in the same manner and to the same extent as the District Court. No change of venue shall be granted in any case. (Ord. No. 80-25, 6-3-80).

2-101.1     General Penalty for Violations of Code; continuing violations.


    
(a) Whenever in this code or any ordinance of the City, an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, regardless of whether a specific penalty for such act or failure to act has heretofore been established by any other ordinance, the violation of any such provision of this code or any such ordinance shall be punishable by a fine of not more than Seven Hundred Fifty Dollars ($750.00), a jail sentence of not more than six (6) months, or both, to which restitution may be added by the trial court. Each day any violation of this code or any ordinance shall continue shall constitute a separate offense. If any such violation is designated as a nuisance under the provisions of this code, such nuisance may be summarily abated by the police department of the City, or a citation may be issued and the violator punished in accordance with this section. In addition to any fine imposed under this section, such violator may be taxed for court costs or such other administrative fees as the court deems necessary for all ordinance violations.

     (b)  This general penalty provision is intended to and shall supersede all other penalty provisions heretofore enacted except as specifically provided hereafter.
 

     (c)  Provided, however, that this uniform penalty provision shall not apply to the specific penalties provided for by the following ordinance sections and sub sections: 7-403.1 Civil Penalties. (Ord. No. 83-12, 6-7-83; Ord. No. 89-24, 11-7-89; Ord. No. 2007-02, 3/6/2007)

2-102     Complaint.

     Actions for violations of Ordinances of this City, may be commenced by filing with the Police Justice a complaint under oath, made by the City Attorney, any member of the Police Department, or any responsible person, stating the nature of the offense, which complaint may be in the following form:

2-103     Defect in Form of Complaint Not Fatal.

     No action before the Police Justice shall be dismissed for any defect in form of said complaint if it substantially sets forth the nature of the violation alleged so as to give the defendant notice of the charge which he is to answer. And such complaint may include several persons charged with the same offense. (Ord. 19, Sec. 3, 8-4-04; 10-3, Rev. Ord. 1938; Rev. Ord. 1963).

2-104     Warrant for Arrest.

     Upon the filing of such complaint, the Police Justice shall enter the case upon his docket in the usual manner as required by law, and shall issue a warrant, which may be in the following form, to-wit:

2-105     Arrest Without Warrant.
 

     Whenever any person has been arrested on view, or otherwise according to law, without a warrant, after a complaint is filed, the Police Justice shall enter in his docket the fact of the arrest, by whom made, and shall hear and determine said charge as if a warrant had been issued. (Ord. 9, Sec. 4, 8-4-04; 10-5, Rev. Ord. 1938; Rev. Ord. 1963).

2-106     Person Arrested May Give Bail.

     Any person arrested for any offense under any Ordinance of the City of Rock Springs, may be admitted to bail by executing a bond to the City of Rock Springs, with sufficient surety to be approved by the Police Justice, conditioned that he will appear upon a day therein named before the Police Justice and answer the accusation for which he has been arrested and not depart from the court without leave thereof, which bond shall be approved by the Police Justice and filed in his office. Said bond may be in the following form:

Police Justice         

    The amount of said bond shall in no case exceed the sum of Two Hundred Dollars ($200.00). (Ord. 19, Sec. 2, 8-4-04; 10-6, Rev. Ord. 1938; Rev. Ord. 1963).

2-107     Failure of Defendant to Appear.

     If the defendant fails to appear according to the conditions of the bond aforesaid, or, appearing, shall depart the court without leave, the Police Justice may enter judgment against him and his sureties for the penalty of said bond. Upon entering judgment, it shall be the duty of the Police Justice to issue process in behalf of the City of Rock Springs, against the parties liable on said bond, requiring them to appear before him on a day to be mentioned therein, and show cause, if any they have, why judgment should not be confirmed against them, and execution issued on such judgment, and any judgment entered up as aforesaid may be set aside by the Police Justice if the defendant shall personally appear before the Police Justice at the time mentioned in said process, and show good cause for setting aside the judgment by affidavit of some credible person; and it shall be lawful for the sureties in said bond to appear before the Police Justice at the time aforesaid, and make the same defense that is allowed for the non-appearance of the principal under the laws of this state in similar cases before the justices of the peace. (10-7, Rev. Ord. 1938; Rev. Ord. 1963).

2-108     Commitment When Party Cannot Be Tried.

     A party in custody who cannot be tried on account of the absence of witnesses, or other causes, and who cannot give bail for his appearance, may be confined in the City Jail or other place of confinement not exceeding three days, and in such case the Police Justice shall deliver to the proper officer a commitment, stating the cause of the detention. (Ord. 19, Sec. 5, 8-4-04; 10-8, Rev. Ord. 1938; Rev. Ord. 1963).

2-109    Trial.

     Cases in the Police Court for violations of City Ordinances shall be tried and determined solely by the Police Justice; except, if a jail sentence is to be imposed upon conviction, a jury trial may be had upon request, which trial shall be held before the Police Justice and a jury. Trial of all cases before the Police Justice shall be conducted in all respects, not hereinotherwise provided for, in like manner as criminal cases before Justices of the Peace, or County Court Judges, as the case may be. (Ord. No. 80-26, passed 6-3-80).

2-110    Witnesses.

     It shall be the duty of said Justice to summon all persons whose testimony may be deemed material as witnesses at the trial, and to enforce their attendance by attachment, if necessary. All witnesses summoned by Police Justice shall receive One Dollar per day for each day in attendance. (10-10, Rev. Ord. 1938; Rev. Ord. 1963).

2-111     Rendition of Judgment.  

     Any person convicted before the Police Justice of any offense under the Ordinances of the City shall be punished by such fines, or imprisonment, as may be regulated by ordinance; provided, no fine shall be greater for any one offense than Two Hundred Dollars, recoverable with costs, and no imprisonment for a longer time than three months.

     Upon the rendition of the judgment against any defendant for the violation of any Ordinance of this City, the Police Justice shall make an order and enter the same upon his docket, and if the defendant shall neglect or refuse to satisfy such judgment and cost of case, he shall be confined in the City Jail or other place of confinement one day for each dollar of such judgment and costs, not to exceed ninety (90) days; provided, that in any prosecution for violation of any ordinance, the defendant shall have the right to produce before said Police Justice one or more sureties to the satisfaction of said Justice, which said sureties shall, with the defendant, confess a judgment for the amount of the fine or penalty imposed, with costs of suit; and said Justice shall enter said confession of judgment upon his docket, and render judgment accordingly in the name of the State of Wyoming, against them for the amount of such fine and costs; and if said judgment be not paid within ninety days from the date of such confession, said Police Justice shall issue execution and collect the amount of said fine or penalty and cost, in the manner provided by law for collecting judgment by execution in Justice's Court. 2-112     Labor on Streets by Convicted Persons.

     Any person convicted of an offense under any Ordinance of the City shall stand committed to the City Jail until the fine and costs assessed against such person are paid, and such person may also, at the direction of the Police Justice, be put to work upon any street, alley, or other public work of this City, for the benefit of this City, and shall be credited on such fine and costs One Dollar and Fifty Cents ($1.50) per day for each day such person shall work. Such prisoner shall be worked under the direction and supervision of the Marshal of this City, or some other person appointed by him. (10-12, Rev. Ord. 1938; Rev. Ord. 1963).

2-113     Malicious Prosecution.

     In all prosecutions for fine or penalty, when the defendant shall be acquitted, the informer or prosecutor may, in the discretion of the Police Justice be adjudged to pay the costs, if it appears to the satisfaction of the Police Justice that prosecution was instituted vexatiously, maliciously or without reasonable cause, and the judgment shall be so rendered and executions shall issue therefor. 2-114     Appeal.

     In all cases before the Police Justice arising under Ordinances of the City, wherein the fine assessed exceeds the sum of Ten Dollars or the imprisonment ten days, an appeal may be taken by the defendant to the District Court in and for the County of Sweetwater, but no appeal shall be allowed unless such defendant shall, within ten days, enter into recognizance with sufficient sureties, to be approved by the Justice, conditioned for the payment of the fine and costs of appeal, and that defendant shall abide the judgment of said Court and not depart without leave of the same, or that he will pay to the said City of Rock Springs the sum of $ ................. The procedure of such appeal shall be as prescribed for appeals from courts of justices of the peace in criminal cases. (10-14, Rev. Ord. 1938; Rev. Ord. 1963).

2-115     General Laws Shall Govern.

     The Police Justice, the City Marshal and all police officers in all matters pertaining to the duties of their respective offices in judicial proceedings, and concerning which there is no specific provision in the general incorporation law, or in the Ordinances of the City, shall be governed by the laws of the State of Wyoming relating to and regulating the practice and proceedings in cases before Justices of the Peace and Constables so far as the same may be applicable. (Ord. 19, Sec. 7, 8-4-04; 10-15, Rev. Ord. 1938; Rev. Ord. 1963).

2-116    Application of City Ordinances at Airport.

     (a)  The ordinances of the City of Rock Springs, Wyoming, be, and they are hereby, declared to be in full effect and in force within the boundaries of the Rock Springs-Sweetwater County Airport, such land being owned by the City of Rock Springs, and the officials of the City of Rock Springs, shall, and they are hereby directed to, enforce such ordinances within the boundaries of such Airport.

     (b)  The Police Justice of the City of Rock Springs shall have the power and jurisdiction, as provided by the laws of the State of Wyoming, to try, hear and determine all cases arising at the Rock Springs-Sweetwater County Airport under the ordinances of the City, and all complaints for the violations of such ordinances. (Ord. No. 75-16, 5-20-75).

2-117.1     Jurisdiction to Enforce Ordinances Within Five Miles.

     That the Mayor of the City of Rock Springs, be, and he is hereby, vested with jurisdiction to enforce at all places within five miles of the corporate limits of the City of Rock Springs, all ordinances of the City of Rock Springs relating to or regarding health or quarantine. (Ord. No. 75-26, 9-30-75).

2-117.2     Designated Ordinances.

     That the Mayor of the City of Rock Springs be, and he is hereby, vested with jurisdiction to enforce, at all places within five miles of the corporate limits of the City of Rock Springs, the following designated ordinances, said ordinances being ordinances duly adopted by the governing body of the City of Rock Springs and relating to health or quarantine:

     Whenever in the above ordinances, reference is made to the corporate limits of the City of Rock Springs, or within the City of Rock Springs, or similar language or phrases relating to or designating the boundaries or corporate limits of the City of Rock Springs, such references shall, for purposes of this ordinance, be construed to mean, and shall mean, within five miles of the corporate limits of the City of Rock Springs. (Ord. No. 75-26, 9-30-75).

2-117.3     Jurisdiction to Enforce Ordinances Within One-Half Mile.

     That the Mayor of the City of Rock Springs be, and he is hereby, vested with jurisdiction to enforce, at all places and areas within one-half mile of the corporate limits of the City of Rock Springs, all ordinances of the City of Rock Springs except those ordinances relating to taxation. (Ord. No. 75-26, 9-30-75).

2-117.4     Designated Ordinances.

    
That the Mayor of the City of Rock Springs be, and he is hereby, vested with jurisdiction to enforce, at all places and areas within one-half mile of the corporate limits of the City of Rock Springs, the following described and designated ordinances of the City of Rock Springs, being ordinances duly adopted by the governing body of the City of Rock Springs, and including all ordinances of said city except those relating to taxation:

     Whenever in the above ordinances reference is made to the corporate limits of the City of Rock Springs, or within the City of Rock Springs, or similar language or phrases relating to or designating the boundaries or corporate limits of the City of Rock Springs, such references shall, for purposes of this ordinance, be construed to mean, and shall mean, within one-half mile of the corporate limits of the City of Rock Springs. (Ord. No. 75-26, 9-30-75).

2-117.5     Police Justice Power and Jurisdiction Within Five Miles.

     That pursuant to the jurisdiction hereby granted to the Mayor of the City of Rock Springs, and vested in such Mayor, to enforce ordinances relating to health and quarantine of the City of Rock Springs, at all places within five miles of the corporate limits of the City of Rock Springs, the Police Justice of the City of Rock Springs be, and he is hereby, vested with power and jurisdiction as provided by the laws of the State of Wyoming, to try, hear, and determine all cases arising within five miles of the corporate limits of the City of Rock Springs, under the ordinances of the City of Rock Springs relating to health or quarantine, and all complaints for the violations of such ordinances. (Ord. No. 75-26, 9-30-75).

2-117.6     Police Justice Power and Jurisdiction Within One-Half Mile.

     That, pursuant to the jurisdiction hereby granted to the Mayor of the City of Rock Springs; and vested in such Mayor, to enforce all ordinances of the City of Rock Springs, except ordinances relating to taxation, within one-half mile of the City of Rock Springs, the Police Justice of the City of Rock Springs be, and he is hereby, vested with power and jurisdiction as provided by the laws of the State of Wyoming, to try, hear and determine all cases arising within one-half mile of the corporate limits of the City of Rock Springs under all ordinances of the City of Rock Springs except those ordinances relating to taxation, and all complaints for the violations of such ordinances. (Ord. No. 75-26, 9-30-75).

2-117.7     Intent.

     It is hereby declared to be the intent of the governing body of the City of Rock Springs to vest in the Mayor of the City of Rock Springs all jurisdiction able to be accorded to him, under the laws of the State of Wyoming, including without limiting the generality of the foregoing, Section 15.1-171, Wyoming Statutes, 1957, Compiled 1965, as the governing body may be empowered to vest, as an exercise of the police power of the governing body for the benefit of, and protection of, the health, safety, and general welfare of the citizens of Rock Springs and of the areas surrounding the City of Rock Springs, and all of its provisions shall be liberally construed with a view to the effectuation of such purpose. (Ord. No. 75-26, 9-30-75).

2-117.8     Severability.

     If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this act which can be given effect without the invalid provision or application. To this end the provisions of this act are severable. (Ord. No. 75-26, 9-30075).
