Article 5-2 OPERATION OF MOTOR VEHICLES


 

5-201      Uniform Act Regulating Traffic on Highways.     

     (a)  The City of Rock Springs, Wyoming by this reference adopts the following provisions of the Wyoming "Uniform Act Regulating Traffic on Highways", Wyoming Statutes Annotated, 2003 Edition, as amended:

           Sections 31-5-101 through 31-5-110 Sections 31-5-112 through 31-5-225(a) Sections 31-5-226 through 31-5-233(g) Sections 31-5-233(j) through 31-5-233(k) Sections 31-5-301 through 31-5-406 Sections 31-5-503 through 31-5-970 Sections 31-5-1102 through 31-5-1112 Sections 31-5-1201 (a) and (c) Sections 31-5-1202 through 31-5-1214

     (b)  A copy of the "Uniform Act Regulating Traffic on Highways" as herein adopted by reference shall be placed on file in the office of the City Clerk and made available for public inspection. (Ord. No. 89-31, 12-5-89, Ord. No. 01-13, 01-15-02)

  5-202     Snowmobiles Prohibited.

      It shall be unlawful for any person to operate a snowmobile in or upon any streets, alleys, sidewalks, parking lots, parks, railroad and utility rights-of-way, or any other public lands or rights-of-way within the City of Rock Springs. 

 5-203      Speed Limits.     

     (a)  It shall be unlawful for any person to drive a vehicle on the streets, highways, alleys or other public rights-of-way in the City of Rock Springs at a speed greater than is reasonable and prudent under the existing circumstances and conditions and having regard for actual or potential hazards.

      (b)  Except when an actual or potential hazard exists requiring a lower speed for compliance with paragraph (a) of this ordinance, the following limits shall be the maximum lawful speeds, and it shall be unlawful to drive a vehicle on the streets, highways, alleys or other public rights-of-way in the City of Rock Springs in excess of such maximum limits:

           (i)   Fifteen (15) miles per hour in alleys;

          (ii)   Twenty (20) miles per hour when passing school buildings or the grounds thereof or school crossings between the hours of 7:30 a.m. to 4:30 p.m. on school days or during other times as posted;

           (iii) Twenty-five (25) miles per hour in all other areas of the City unless otherwise posted;

           (iv) As posted on official traffic signs in accordance with other applicable City ordinances or state laws in areas where circumstances and conditions warrant a maximum speed greater or less than that otherwise herein specified for the safe and reasonable flow of traffic.

     (c)  Any person who is convicted of speeding under this Section and the violation occurs within a residential zone, shall be punished by a fine of not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00).  In addition to any fine, the person may be sentenced to a term in jail not to exceed six months.

            (i)  Residential zone shall mean those areas within the City which have been designated R-1, R-2, R-3, R-4, R-5 or R-6.

            (ii)  This penalty provision is intended to be an exception to the general penalty provisions of Section 2-101.1 of the Compiled Ordinances of the City of Rock Springs, Wyoming.

 5-204      Careless Driving.     

     Who ever operates a motor vehicle upon any public highway within the City of Rock Springs or upon any public parking area or lot within the City of Rock Springs in a manner which is not consistent with the exercise of due and diligent care normally exercised by a reasonably prudent person under similar circumstances, and where such operation of a motor vehicle creates an unreasonable risk of harm to persons or property within the City of Rock Springs, is guilty of careless driving and upon conviction may be sentenced to pay a fine not to exceed Seven Hundred Fifty ($750.00) Dollars.  5-205      Driving While License Cancelled, Suspended or Revoked.

     (a)  Any person who drives a motor vehicle on a public street or highway within the City of Rock Springs at a time when his or her Wyoming driver's license or privileges have been cancelled, suspended or revoked by the State of Wyoming or any other jurisdiction or at a time when any nonresident operating privilege, license or permit has been cancelled, suspended or revoked pursuant to the laws of the State of Wyoming or any other jurisdiction, is guilty of DRIVING WHILE LICENSE CANCELLED, SUSPENDED OR REVOKED.

     (b)  Any evidence that a notice or order from the Wyoming Department of Revenue and Taxation or the division administering the motor vehicle laws within said department or any similar agency in any other state or jurisdiction was mailed to the last known address for the person charged under section (a) shall be prima facie proof that the person received the notice or order five (5) days after the notice or order was mailed. Last known address shall mean the address on file with the Wyoming Department of Revenue and Taxation or the division within said department administering the motor vehicle laws or any similar agency in any other state or jurisdiction. 5-206.   Use of Engine Compression Brakes Prohibited.

 

     No person shall operate or use any vehicle engine compression brake within the corporate limits of the City.

 

5-207.     Regulation of Motorized Skateboards on Streets and Bike Paths. 

     1.  As used in this ordinance: Motorized Skateboards means:  a self-propelled device which has a motor or engine, a deck on which a person may ride and at least two (2) wheels in contact with the ground and which is not otherwise defined under state law as a "motor vehicle", "motor cycle", "motor-driven cycle" or "pedestrian vehicle".

          Daylight hours means:  one-half (½) hour before sunrise and one-half (½) hour after sunset.

     2.  No person shall operate a motorized skateboard in violation of this section.  A violation of this section is a misdemeanor.

           (a)  All persons riding a motorized skateboard must be age ten (10) or older and a helmet must be worn at all times.

          (b)  Motorized skateboards shall be operated exclusively on residential streets as designated on the Transportation Plan map or on bike paths, if such bike paths are designated by the Governing Body as being appropriate for motorized skateboards.  On bike paths approved for motorized skateboard use, the Governing Body shall cause signs to be erected to notify the public that the bike paths are approved for motorized skateboards.  No motorized skateboard shall be operated on a collector street or arterial street as designated on the Transportation Plan map.

           (c)  Motorized skateboards may be operated during daylight hours only.

           (d)  Motorized skateboards must be operated in accordance with all traffic signs.    (e)  Motorized skateboards shall not be used to tow any apparatus; and only one rider shall ride a motorized skateboard.
