Article 13-10 FEES, VIOLATIONS, PENALTIES AND REMEDIES


13-1001     Fees.

     A.  Purpose.

          It is the intent of this Ordinance to require petitioners to pay a portion of the public services that are necessary for processing their request. While the City is not expecting one hundred (100%) percent recovery of all costs, it does feel that all required publication and mailing costs plus a portion of administrative costs should be borne by the petitioner.

     B.  Application Fees.

          The following application fees shall accompany the respective petition. The fees are intended to cover the expenses of public notices placed in the newspaper and for postage to mail notices to adjacent property owners. 

Section 13-10-01 Fees.

    A.    Purpose.

    *If subdivision plat is required, final plat fees as specified in the Subdivision Ordinance shall be required. (Ord. No. 87-28, 12-1-87;Ord.No. 89-20, 9-19-89; Ord. No. 2008-17, 9-2-2008).

13-1002     Violations and Penalties.

     A.  No person shall locate, erect, construct, reconstruct, enlarge, change, maintain, or use any building or structure or use any land in violation of this Ordinance.

     B.  The Zoning Enforcement Officer shall order in writing the remedying of any violation. Such order shall state the nature of the violation, the ordinance provision violated, and the time by which the violation must be corrected. After such order has been served, no work shall proceed on any structure or tract of land covered by such an order except to correct such violation or to comply with the order.

     C.  Decisions of the Zoning Enforcement Officer may be appealed to the Board of Adjustment in accordance with Section 13-907 of this Ordinance.

     D.  In addition to or in lieu of the procedures outlined above, this Ordinance shall be enforceable in a court of proper jurisdiction, and any or all appropriate remedies at law or in equity shall be available for the enforcement thereof.

     E.  Any person or party who is convicted of a violation of this Ordinance shall be subject to fine and penalty according to Section 2-101.1 of the Ordinances of the City of Rock Springs.

     F.  This Ordinance shall not be construed to hold the City of Rock Springs, its Zoning Enforcement Officer, Chief Building Inspector or any other City official responsible for any damage to persons or property by reason of any inspection or reinspection authorized herein or the failure to so inspect or reinspect or by reason of the issuance of a building permit as herein required.
