Article 16-1 SCOPE AND PURPOSE 16-101 Authority.
This Ordinance is
adopted pursuant to and in accordance with the authority vested in the City
Council of the City of Rock Springs, by the Statutes of the State of
Wyoming, Sections 15-1-601 through 15-1-612, and Sections 34-12-101 through
34-12-115. All previously existing subdivision regulations for the City of
Rock Springs are hereby repealed.
This Ordinance shall
be known, cited and referred to as the Subdivision Regulations of the City
of Rock Springs, Wyoming. This Ordinance is enacted for the purpose of: (A) Ensuring orderly development in conformance with a duly adopted Comprehensive Plan, which may include a major street plan. (B) Protecting the public health, safety, and general welfare of present and future residents of the City of Rock Springs, Wyoming. (C) Establishing standards and procedures for the protection of the common interests of the general public, the landowner, and the subdivider. (D) Protecting the character and value of lands and buildings throughout the City of Rock Springs and minimizing conflicts among the uses of land and buildings. (E) Providing for safe and adequate transportation systems, utilities and other public facilities. (F) Establishing adequate and accurate records of land subdivision. (G) Encouraging the use of innovative land planning and urban design techniques16-104 Severability. It is hereby declared to be the intention of the City that the several provisions of this Ordinance are severable in accordance with the following:
If any court of competent
jurisdiction shall adjudge any provision of this Ordinance be invalid, such
judgment shall not affect any other provisions of this Ordinance not
specifically included in said judgment. If any court of competent
jurisdiction shall adjudge invalid the application of any provisions of this
Ordinance to a particular property, building, or other structure, such
judgment shall not affect the application of such provision to any other
property, building, or structure not specifically included in said judgment. In the case of a conflict between this Ordinance and/or any part thereof, or any other Ordinance of the City of Rock Springs, the more restrictive in all cases shall apply.
