Rock Springs Code

 

Prior to the adoption of 99-02 on 02/02/1999, Section 1-402 read as follows.

 
    The appointive officers of the City of Rock Springs, Wyoming shall be Administrative Assistant to the Mayor, City Attorney, such number of Assistant City Attorneys as the City Council may authorize, Director of Department of Finance and Administration, City Clerk, City Treasurer, Municipal Judge, Alternate Municipal Judges, Fire Chief (subject to competitive testing through the Civil Service regulations), City Engineer, Director of Public Works, Director of Parks and Recreation and Chief of Police. Said officers shall be appointed by the Mayor, by and with the consent of the Council. Any officer not appointed or reappointed pursuant to this section shall have his or her employment with the City terminated at the time of the vote taken by the City Council on the appointment. In such case, the Mayor shall appoint, from within the department wherein the vacancy exists, a person to serve as the appointive officer on an interim basis. This person shall hold the position for no more than thirty (30) days without prior approval of the majority of the City Council. Every thirty (30) days thereafter, a majority of the governing body shall vote to allow the interim position to exist for an additional thirty (30) days. Within sixty (60) days of the date of the creation of the vacancy, the Mayor shall make the nomination of a new appointee unless an extension of this time period is granted by vote of the majority of the governing body. The terms of the Assistant City Attorneys and Alternate Municipal Judges shall be at the will of the Mayor. (Ordinance No. 9, 8-4-04; 3-2, Rev. Ord. 1938; Amend. Ord. 864, 1-7-46; Amend. Prior to the adoption of Ord. 94-31 on 09/18/1998, Section 1-506 read as follows.

 

    Before entering upon the duties of his office, the City MarshalChief of Police shall execute to the City a bond in the sum of Five Thousand Dollars, and each regular Deputy Marshal shall execute to the City a bond in the sum of One Thousand Dollars.

    It shall be the duty of the MarshalChief of Police to attend all meetings of the Council. The Marshal Chief of Policeshall be the Chief of Police and shall perform the duties incumbent upon such office, and shall have the immediate superintendence of the Deputy MarshalsPolice Department. When the Marshal shall deem such a course necessary for the preservation of law and order in the City, he shall with consent and approval of Mayor appoint such special Deputy Marshals as he may deem necessary for the purpose, and such special Deputies shall have the same right and power and shall be governed by the same rules and regulations as are the regular Deputy Marshals; provided, that such appointment shall be made in writing, and, provided further, that no appointment made under the provisions of this section shall extend beyond the next regular meeting of the City Council, and at such meeting the Marshal shall make a full report of all appointments made by him, hereunder, setting forth fully the causes for such appointments. The Marshal shall have full control and authority over all Deputy Marshals, both regular and special, and may make such rules and regulations regarding the Police Force of the City as he shall deem proper, so long as they do not conflict with the Ordinances of the City, the laws of the State of Wyoming, or the laws of the United States of America. But if any Deputy Marshal shall consider the rules imposed by the Marshal harsh or unjust, he shall make complaint thereof to the Mayor, and the Mayor, if he considers it advisable, may order the rules imposed by the Marshal discontinued and annulled. If the Marshal shall have any reason to complain of any acts or of any Deputy Marshal by reason of his failing to obey any regulation imposed under the provisions of this Ordinance or by reason of his failing to perform his duty, or for any other just cause, such complaint shall be made to the Mayor and City Council, and the Mayor and City Council shall take such action in the premises as to them shall seem just and proper.
    The Marshal and Deputy Marshals shall have power within the City, and it shall be their duty to arrest all offenders against the laws of the State, or of the City, by day or by night, and to keep them in the City prison or other place, to prevent their escape until a trial or examination may be had before a proper officer. It shall be the duty of the Marshal and Deputy Marshals to keep and preserve the peace in the City and to quiet and suppress all affrays, riots, and unlawful assemblies and insurrections, for which purpose, and in apprehending and securing any person for felony or breach of the peace, they may call to their aid such person or persons of the City as they may deem necessary. The Marshal in person, or by his Deputy Marshals, shall serve and execute, according to law, all processes, writs, warrants, and orders issued out of the Police Court, or made by lawful authority and to him directed, and the Marshal and Deputy Marshals shall perform such other duties as may be required of them by the Ordinances of the City or by direction of the Mayor. Article 1-5 Powers and Duties of Officers

Prior to the adoption of 99-03 on 02/02/1999, Section 1-509 read as follows.

 
    The City Engineer shall, when required or requested by the City Council or Mayor, make all surveys, estimates, maps and profiles required for any City work or improvement, and shall, when so directed, superintend the construction of drains, sewers, water mains, sidewalks, curbs, gutters, or other improvements, and he shall keep in his office a book which shall be public record of the City of Rock Springs, in which he shall record a statement of his official acts, surveys, other work done in relation to any such improvements, and which shall accurately describe the location of all drains, sewers, water mains, and all openings made therein, or thereafter made, and the location thereof, and the date of construction.
    He shall make and keep in his office a map or maps showing the official grades of all streets, sidewalks, curbs and gutters, and the location of all water mains and sewers, the location of all connections therewith, and of all fire hydrants and of all valves in water mains. He shall keep and make such other records as shall be prescribed by Ordinance or as the City Council or Mayor shall direct. At the expiration of his term of office, he shall turn over to his successor all papers, records, books and maps aforesaid. (4-9, Rev. Ord. 1938; Rev. Ord. 1963).

    The City Planner shall perform such duties as designated and directed by the Mayor and the Director of the Department of Engineering, Planning and Community Development jointly. (Ord. No. 2222, 7-1-74).

    The Director of the Department of Engineering, Planning, and Development shall direct and control the budgetary, planning, and operational activities of the department. He shall supervise and direct the community development implementation program, priority work programs, housing, development, zoning, and planning functions, and shall perform such other duties and functions as may be required of him by the Mayor or the Ordinances of the City.     The Director of the Department of Public Works shall direct and control the budgetary, planning and operational activities of the department, and shall perform such other duties and functions as may be required of him by the Mayor or the Ordinances of the City. (Ord. No. 2159, 12-27-73).

    2.    The Position Title of each position as classified herein shall be used to designate such position in all budget estimates, payrolls and other official records, documents, vouchers, and communications, and in all personnel processes.
 

    3.    The salary steps for the respective positions and grades, as set forth in Subsection 1 herein, shall be adopted, changed and/or amended from time to time by Resolution of the Governing Body of the City of Rock Springs and shall constitute the plan of compensation for those respective positions:  See Chart #1.  Police Officers, Sergeants, Lieutenants and Commanders shall be paid pursuant to a pay scale adopted, changed and/or amended from time to time by Resolution of the Governing Body of the City of Rock Springs and shall constitute the plan of compensation for those respective positions:  See Chart #2.
