Article 8-2 ORGANIZATION OF FIRE DEPARTMENT


8-201 Organization.

(a) Strength of Force. The Fire Department of the City of Rock Springs shall consist of a Chief of the Fire Department, a First Assistant Fire Chief, a Second Assistant Fire Chief, four (4) fire truck drivers, and eight (8) part time firemen.

(b) Order of Command. In the absence of the Fire Chief, or whenever the Fire Chief is not in attendance at any fire, the First Assistant Fire Chief shall be in charge and have the same authority as the Fire Chief; in the absence of both the Fire Chief and the First Assistant Fire Chief, the Second Assistant Fire Chief shall be in charge and have the same authority as the Fire Chief.

(c) Compensation. All officers and members of the Fire Department shall receive such compensation as may be fixed by the City Council, and shall be appointed by the Mayor subject to the approval of the Council.

(d) Additional Appointments. The Mayor may appoint such additional men as may be necessary for the efficient service of the department, subject, however, to the approval of the Council. (Ord. No. 6, Art. I, Sec. 1, 8-4-04; 30-1, Rev. Ord. 1938; Amend. Ord. 897, 9-9-46; Rev. Ord. 1963).

8-202 Rules and Regulations.

(a) The Fire Department may adopt such rule and by-laws as may be deemed necessary for its proper organization and regulation, not in conflict with the City Ordinances.

(b) The Fire Department shall be under the sole control of the Fire Chief, who shall act by and with the advice of the Mayor and City Council. (Ord. No. 6, Art. I, Sec. 1, 8-4-04; 30-2, Rev. Ord. 1938; Rev. Ord. 1963).

8-203 Conduct at Fire.

Upon the alarm of fire, all members and officers of the Fire Department shall hasten to the place of fire with their engines, hose, and other fire apparatus, and under the proper officer, shall continue to exert their utmost efforts to extinguish the fire until released by the officer in charge. They shall then return their engines, hose, and other fire apparatus, thoroughly cleaned, to their respective places of keeping. (Ord. No. 6, Art. I, Sec. 3, 8-4-04; 30-3, Rev. Ord. 1938; Rev. 8-204 Aid to Fire Department.

The City Marshal, Fire Chief, Assistant Fire Chief, or any officer in charge of the Fire Department may require the aid of every citizen, inhabitant or bystander in drawing any engine, cart, or other fire apparatus to the fire, or to assist in extinguishing the fire; and, upon refusal or neglect of any such person to immediately comply with such requirement, the offender shall be guilty of a misdemeanor to which may be added the costs at the discretion of the Court. 8-205 Unlawful Interference With Officers, Apparatus, Etc.

Any person who shall wilfully hinder or interfere with any officer or fireman in the discharge of his duties at a fire, or in any manner injure, deface or destroy any engine, hose, or other fire apparatus belonging to the City, or shall wilfully break or injure any water pipe or in any way interfere with the water or its source of supply, or interfere with, injure, cut, deface or break any wire, insulator or pole, or any apparatus, appliance or fixture whatsoever, appertaining to or in any way connected with the fire alarm system of the City shall be deemed guilty of a misdemeanor and upon conviction thereof may be added the costs at the discretion of the Court. 8-206 Civil Service Commission.

The provisions of Chapter 49, Session Laws 1933, creating a Fire Department Civil Service Commission, and appointing three members to serve on that Commission for 1, 2 and 3 years respectively, is hereby adopted. (Resol. 641, 12-26-39; Rev. Ord. 1963).
