Article 8-4 PERSONNEL REQUIREMENTS


8-401 Policemen and Firemen to Be Available at All Times.

(a) Policemen and firemen employed by the City of Rock Springs shall be available for call to duty at all times.

(b) No policeman or fireman employed by the City of Rock Springs shall engage in any outside occupation, job, or employment.

(c) No policeman or fireman employed by the City of Rock Springs shall engage in any activity, for pay or otherwise, while off duty, which would tend to subject such policeman or fireman to outside interests which might conflict with his official duties.

(d) With the consent of the Mayor, the City Marshal may grant special permission to any police officer and the City Fire Chief may grant special permission to any fireman, to accept off-duty employment when, in the opinion of the City Marshal or the City Fire Chief, such off-duty employment will not conflict with the official duties of such policeman or fireman.

(e) If any part of this Ordinance shall be held invalid, such part shall be deemed severable and the invalidity thereof shall not affect the remaining parts of this Ordinance. (Ord. No. 75-31, 12-16-75).

8-402 Policeman and Fireman to Be Residents of City.

(a) Policemen and firemen employed by the City of Rock Springs shall be residents of, and shall be domiciled in and live within, the corporate limits of the City of Rock Springs except as hereinafter providereinafter provided.

(b) Any police officer or fireman presently employed by the City of Rock Springs and living outside the corporate limits of the City shall have ninety (90) days from the date of passage of this Ordinance within which to establish residence within the City limits. The governing body of the City of Rock Springs may, in special cases, grant extension of such time of compliance in cases where hardship is shown.

(c) In those cases where suitable housing is not reasonably available within the corporate limits to firemen or policemen, upon determination by such fireman's or policeman's department head that such is the case, the department head shall, in writing, make a recommendation to the governing body that a policeman or fireman may reside outside the corporate limits. The recommendation shall show the reasons upon which the recommendation is based and specifically state that the place where suitable housing is available is within a reasonable response time set by the individual department head to assure that said officers residing under these special arrangements will respond to emergency calls by arriving at emergency stations in short order. The governing body may or may not approve each individual case; but, if approved, such policeman or fireman shall not be forced to later move to a location within the Corporate Limits. (Ord.
